What is Probate?
Probate is the process of transferring the assets of a person who has passed to their heirs. It’s required where a decedent left assets titled in his or her name. An attorney is required for all probate administration except where only personal property of nominal value is being transferred.
What type of probate administration do I need?
Summary Probate is an expedited procedure for those estates valued at less than $75,000 and no debt or estates where the decedent has been deceased for at least two years.
Formal administration is for those estates valued over $75,000 or estates with creditors.
Ancillary Administration is administration for decedents who were citizens of other states, but also own property in Florida.
I’m an heir in a probate case, should I get an attorney?
That’s up to you. It’s not required. However, many heirs choose to be represented to ensure the estate is administered properly and that they are being treated fairly.
